This policy describes the types of information Navio Networks, Inc., its subsidiaries and affiliates (collectively, "Navio" or "We") may collect from you or that you may provide when you visit any and all Navio properties, including, but not limited to, owned or operated brands, websites, applications, or other services, including but not limited to any content or programming delivered over the Internet via applications on consumer devices, including but not limited to, desktop computers, mobile phones, tablets, connected television devices, or other similar devices that link to or reference this Privacy Policy, and all corresponding domains, subdomains, web pages, and websites associated therewith (our "Properties"), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy describes the types of information we may collect or that you may provide:

  • On the Properties.

  • In email, text, and other electronic communications between you and the Properties.

  • Through mobile and desktop applications you download or access from the Properties, which may provide dedicated non-browser-based interaction between you and the Properties.

  • When you purchase, download, install, register with, access, or use the Properties.

  • We collect offline or through any other means; or

CHILDREN UNDER THE AGE OF 13

Our Properties are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Properties. We do not knowingly collect personal information from children under 13. Some content or applications, including advertisements, on the Properties are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. For example, if you give us an email address to use the "email a friend" feature of our Properties, we will transmit the contents of that email and your email address to the recipients.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Navio, our customers, or others.

 

NOTICE TO USERS OUTSIDE OF THE UNITED STATES

 

Navio is a California corporation and the products and services available on the Properties are provided by or on behalf of Navio based in the United States. If you are located outside of the United States, be advised that the Personal Information that you provide will be transferred to and maintained inside and outside the United States, and these jurisdictions’ data protection and privacy laws may not off the same level of protection as those of the country where you reside or are a citizen. If you do not consent to this transfer, do not accept this Privacy Policy or otherwise use the Properties. By using our Properties and providing us with your information, you are consenting to the transfer and processing of such information in the United States and other countries.

 

EUROPEAN UNION CITIZENS OR RESIDENTS

 

On May 25, 2018, the General Data Protection Regulation (GDPR) takes effect. All natural persons whose personal data is processed by Navio within the territorial scope of the GDPR, are Data Subjects and entitled to certain rights. Depending on your location, we may provide you with the ability to access, download, and request deletion of your personal information.

If you are a Data subject in the European Union, you have the following rights under GDPR, subject to certain exceptions:

Right of Access: You have the right to know whether personal data concerning you is being processed, and if so, the purpose of the processing, categories of data concerned, recipients to whom the data are disclosed and the legal basis for processing the personal data.

Right of Rectification or Erasure - “Right to be Forgotten”: When Navio holds personal data about you that is inaccurate, incomplete or no longer necessary for the purposes for which it was collected, you have the right to ask Navio to rectify, complete, or erase the personal data.

Right to Restrict Processing: You have the right to restrict processing of your personal data by asking Navio to limit what we do with it.

Right to Data Portability: You have the right to certain personal information Navio stores about you in a structured, commonly used and machine readable format for transfer to a third party of your choosing;

Right to Object to Automated decision-making: You have the right not to be subject to automated decision making where this has legal or other significant consequences, except where you have explicitly consented to this or where it is necessary for entering into or performing a contract.

Right to Withdraw Consent: You have the right to withdraw your consent allowing Navio to process your information at any time and prevent the processing of their data for direct electronic marketing purposes.

Exceptions: You can object to processing of your personal data under certain circumstances, unless there is a legitimate ground for processing the personal data, where you have explicitly granted consent, where it is necessary for entering into or performing a contract, or where Navio needs to process the data to establish, exercise or defend legal claims.

 

CALIFORNIA RESIDENTS

 

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

Effective January 1, 2020, If you are a California resident, California law may apply to how we collect and use your personal information, and what rights you have in some circumstances.

The California Consumer Privacy Act of 2018 (CCPA) and other California privacy laws entitle California residents to the following rights:

  • The right to request information about personal information that we have collected about that customer in the twelve (12) months preceding the customer's request (including the categories of information collected, the source of that information, the business purpose of that collection, the categories of third parties with whom that information is shared, and the specific pieces of personal information collected about that particular customer);

  • The right to receive requested information in a readily usable format if provided electronically;

  • The right to request that we delete any personal information about the consumer that we have collected (subject to exceptions which may entitle Navio to retain some information for certain purposes);

  • The right to opt-out of "sales" of personal information to third parties, if applicable; and

  • The right to freely exercise your rights without being denied goods or services.

We cannot respond to your request to access or delete information unless we are able to both verify your identity or authority to make the request and confirm the personal information relates to you and/or your household. If you have an account on any of our Sites or Applications, we may verify your identity by having you log in to your account. If you do not have an account on our Sites or Applications, we will attempt to verify your request by asking you to provide identifying information that we will match to information in our files. We will only use information you provide in your request for the purpose of verifying your identity or authority to make the request.

We may deny deletion requests in whole or in part as permitted or required by applicable law. We do not charge a different price or rate or provide a different level or quality of goods or services based on your exercising your CCPA rights. We do not sell personal information.

If you are a California resident under the age of 18, and a registered user of any site where this policy is posted, you may request and obtain removal of content or information you have publicly posted on such site.  To make such a request, please send an email with the subject line “California Minor Content Removal Request” to bizdev@navio.tv.  Please specify in your request which website or application your request relates to and the specific information or content that you would like removed. Please note that your request does not ensure complete or comprehensive removal of the content or information, because, for example, some of your content or information may have been reposted by another visitor to our websites.

 

DATA SECURITY

 

Platforms and Devices

The Properties may operate on platforms and devices not controlled by us. Those platforms and devices may use, collect and disclose information, including your Personal Information, subject to their own privacy policies. The platform and the platform licensees may use, collect and disclose data according to the terms of its privacy policy, other than data you provide directly to Navio through the Properties, and data generated by us regarding your behavior within the Properties.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Properties, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Properties like message boards. The information you share in public areas may be viewed by any user of the Properties.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Properties. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Properties.

 

CHANGES TO OUR PRIVACY POLICY

 

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will notify you through a notice on the Properties home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Properties and this privacy policy to check for any changes.
